Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between Quantum Ventures FZC, a company incorporated in the Sharjah Publishing City Free Zone, United Arab Emirates, doing business as Tripsy (“Tripsy,” “we,” “our,” or “us”), and you.
They govern your access to and use of the Tripsy website at getripsy.com; the Tripsy web application, including when installed to your device as a progressive web app; AI-powered travel planning tools; itinerary generation and management; Membership and Trip Pass purchases; Tripsy Circle and other community features; identity verification; user content; and all other products, software, services and features we operate (together, the “Services”).
If we later release native mobile applications or make the Services available through additional platforms or distribution channels, these Terms will apply to those as well, and we may publish supplemental terms specific to them.
By creating an account, purchasing anything, accessing the Platform, or using any part of the Services, you acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Community Guidelines, Refund Policy, Cookie Policy and Affiliate Disclosure. If you do not agree, you must stop using the Services.
1. 1. About Tripsy
Tripsy is an AI-powered travel planning platform that helps you organise, discover and experience travel, and connect with a trusted community of travellers.
Depending on your plan and eligibility, the Services may include AI-generated itineraries; destination recommendations and travel inspiration; trip organisation and saved trips; travel, visa, vaccination and safety information generated with artificial intelligence; Tripsy Local; Tripsy Circle, a community space in which eligible Members publish posts and attached photos or video; discovery of other eligible Members; and features we introduce later.
1.1 What Tripsy is not
Tripsy is not a travel agency, tour operator, airline, hotel or accommodation provider, booking provider, insurer, healthcare provider, immigration adviser, legal adviser, security provider, employment platform, dating service, matchmaking service, or an organiser or supervisor of interactions between Members.
We do not sell flights, accommodation, insurance or tours. Any booking you make happens directly with a third party on that third party's terms. Travel decisions, bookings and interactions between Members remain your own responsibility.
1.2 Artificial intelligence and accuracy
The Services rely substantially on artificial intelligence. AI-generated output — including itineraries, prices, schedules, destination information, visa and entry information, vaccination and health information, and safety information — may be inaccurate, incomplete, outdated or wrong.
It is provided for planning and information only. You must independently verify anything that matters before relying on it, and in particular before booking travel, entering a country, or making a health or safety decision. See sections 24 and 31.
1.3 Health information is not medical advice
Tripsy may surface vaccination requirements, health precautions and related travel-health information. Tripsy is not a healthcare provider and does not give medical advice, diagnosis or treatment. Always consult a qualified professional or travel health clinic for your destination and circumstances.
1.4 Safety information is informational only
Tripsy provides safety-related information such as neighbourhood notes, common local scams, water safety and general precautions, including through features designed for women travellers.
This is information, not a safety guarantee, risk assessment, or professional security advice. Verify it against your government's official travel advisories, the official sources of the country you are visiting, and local authorities. Conditions change quickly and we cannot warrant that any safety information is current or complete for your circumstances.
Tripsy is not responsible for your safety and does not monitor, supervise or intervene in your travel or your interactions with other Members.
1.5 The free plan, and what it includes
The free plan is genuinely usable, and limited. As at the effective date of these Terms it provides:
- three (3) trips per calendar month. The count resets at the start of each month, and a generation that fails is not counted against you;
- three (3) AI edits per trip. This is a lifetime count for that trip, not a monthly one, and it does not reset;
- seven (7) days of full access to each itinerary from the moment it is created;
- the safety layer, in full, permanently — visa rules for your passport, vaccinations, tap water and local scams are never withheld on any plan.
After the seven days, the day-by-day plan, flights and accommodation details become inaccessible until you unlock that itinerary with a Trip Pass or hold an active Membership. Your itinerary is retained, not deleted, and access is restored immediately on unlocking.
We may change these limits. Where a change reduces what the free plan offers, we will publish the new limits before they take effect.
2. 2. Acceptance of these Terms
These Terms apply whenever you visit our website; use or install the Tripsy web application; create an account; purchase a Membership or Trip Pass; access AI-powered features; participate in Circle; connect or communicate with another Member through the Services; upload content; or otherwise use any part of the Services.
By using the Services you represent that you have read and understood these Terms; have the legal capacity to enter a binding agreement; will comply with these Terms and applicable law; that all information you provide is accurate, complete and current; and that you accept responsibility for activity conducted through your account.
If you are accessing the Services on behalf of an entity, you represent that you have authority to bind it.
2.1 Connections between Members
The Services may allow Members to become aware of, or connect with, one another. Any communication, arrangement or meeting between Members — online or in person, whether or not it originated through the Services — is voluntary and arranged solely between those Members.
Tripsy does not arrange, schedule, supervise, chaperone or participate in any such interaction, and accepts no responsibility for it. See section 35.
3. 3. Definitions
- Account — a registered user profile created to access the Services.
- AI Output — any itinerary, recommendation, conversational assistance, planning suggestion, budget, travel insight or other output generated wholly or partly by artificial intelligence.
- Circle, or Tripsy Circle — Tripsy's community features as they exist from time to time. At present: destination-based community spaces in which eligible Members publish posts and attached photographs or video, and can see other eligible Members.
- Content — any information, text, photographs, video, reviews, itineraries, travel notes, recommendations, audio, graphics or files submitted, generated, displayed or transmitted through the Services.
- Member — any individual who has created a Tripsy Account.
- Membership — the paid subscription to Tripsy, billed monthly or annually.
- Platform — the Tripsy website, web application, software, APIs, databases, AI systems, community features and associated technology.
- Trip Pass — a one-off purchase that permanently unlocks a single itinerary on the purchasing Account.
- User — any individual who accesses or uses the Services, whether or not they have an Account.
- Verification — the identity verification process performed by an independent third-party verification provider selected by Tripsy.
- Verified Member — a Member whose Account successfully completed the verification provider's identity verification workflow on the date that check was performed.
The Verified designation records the outcome of that check on that date. It is not ongoing, and it is not a statement about the person's present identity, character or conduct. In particular it does not mean Tripsy has performed a criminal background check; screened for prior conduct; investigated the Member's reputation; confirmed the Member's identity remains accurate after the date of verification; confirmed the verified individual is the person currently using the Account; certified the Member as safe; endorsed her character; or guaranteed that any interaction with her will be safe or appropriate.
Verification status may be revoked at any time. Always exercise your own judgment before communicating with, sharing information with, or meeting any Member, including a Verified Member. See section 36.
4. 4. Eligibility
To use the Services you must be at least eighteen (18) years old; have legal capacity to enter binding contracts; comply with applicable law where you live and where you travel; provide truthful registration information; and maintain only one personal Account unless we agree otherwise in writing.
You may not use the Services if your Account has previously been suspended or terminated; you are prohibited by law from using them; you provide false or misleading information; you impersonate another individual; or your use would violate applicable law.
We may request additional information to confirm eligibility or identity at any time. Failure to provide it may result in restricted functionality, suspension or termination.
5. 5. Women-only community features
Tripsy Circle and certain other community features are intentionally designed for women, to foster a trusted travel environment.
Access requires successful Verification, including confirmation that you are at least eighteen (18), together with any further eligibility requirements we establish, and an active Membership.
We may approve, deny, suspend or revoke access where we reasonably determine that eligibility requirements are not satisfied; information provided is inaccurate; verification cannot be completed; these Terms or the Community Guidelines have been violated; or continued participation could harm the integrity or safety of the community.
Access to women-only features must never be interpreted as a guarantee of the safety, trustworthiness, compatibility or future conduct of any Member. We do not represent that any Member is free from risk, and all Members remain responsible for exercising appropriate caution.
6. 6. Changes to these Terms
We may modify these Terms to reflect changes in our Services, legal obligations, technology, security practices or business operations.
Where required by law we will give reasonable notice before material changes take effect. Continued use after revised Terms take effect constitutes acceptance. If you do not agree, stop using the Services and cancel your Account. Changes to the Services themselves are covered by section 41.
7. 7. Account registration
When creating an Account you agree to provide accurate, complete and current information; keep it accurate; keep your credentials confidential; notify us without unreasonable delay if you believe your Account has been compromised; and accept responsibility for activity under your Account other than activity arising after you have notified us of unauthorised access.
You may not create an Account with false information; impersonate another individual or organisation; create multiple personal Accounts without our written permission; sell, transfer, rent or otherwise provide your Account to another person; or let another person use the Services through your Account.
We may suspend, restrict or terminate any Account that violates these Terms or that we reasonably believe is being used fraudulently.
8. 8. Account security
You are responsible for keeping your credentials confidential and for securing any device you use.
Tripsy will never ask for your password by email or message. If you believe your Account has been compromised, tell us immediately at hello@getripsy.com.
We are not responsible for losses resulting from unauthorised access where that access results from your failure to protect your credentials or devices.
9. 9. Identity verification
Certain features, including Circle, require successful Verification. It is performed by an independent third-party provider we select.
Tripsy does not receive or store the government-issued identity documents you submit. Those are handled by the verification provider. From the result, we retain only what we need to administer the Services: the verification status and date, and a small number of eligibility attributes, including whether you are over eighteen (18) and the sex recorded on your document. Full detail is in our Privacy Policy.
We may require Verification before granting access to certain community features; where fraud is suspected; where duplicate Accounts are detected; to comply with law; or where we reasonably determine it necessary. Failure to complete Verification may limit or prevent access to certain features.
We may revoke verification status where the provider withdraws or invalidates a result; we reasonably believe the process was circumvented or abused; information supplied is materially inaccurate; eligibility is no longer satisfied; or continued verification would present legal, security or community risk.
Verification confirms only that the workflow was completed according to the provider's procedures on the date performed. It is not a background check, a guarantee of identity at any later time, an endorsement, a certification of character, or an assurance of safety.
10. 10. Membership plans
Certain features are available only with a paid Membership. Plan details — pricing, billing frequency, included features and any promotional terms — are shown at the time of purchase, and the checkout page is authoritative.
We may introduce, modify or discontinue plans. Changes will not affect existing Members except as stated in these Terms or required by law. See also section 41.
10.1 Founding Membership
We may offer a Founding Membership at a reduced annual price, limited to a fixed number of Members. Where you purchase one, the price you paid at signup continues to apply on each renewal for as long as that Membership remains active without interruption, even if we later raise standard prices.
This protection ends if the Membership lapses, is cancelled, or is terminated — including where it ends because a renewal payment could not be collected. If you resubscribe afterwards, the then-current standard price applies. Founding places are limited and once allocated may not become available again.
10.2 What “unlimited” means
Membership is described as providing unlimited trips. In normal use it is: there is no cap you will meet by planning your own travel.
It is subject to a fair-use limit of 100 trips per calendar month. That limit exists to stop automated abuse and to protect the service for everyone — it is not a commercial restriction, and it is far above what any individual traveller plans. Unlimited AI edits, saved trips and Circle access are not subject to it.
If you reach it, we will tell you why and, where the use is genuine, lift it.
11. 11. Billing and automatic renewal
Memberships are billed in advance, monthly or annually, according to the plan you select at checkout. Trip Passes are one-off purchases — see section 12.
All payments are processed by our payment provider, Stripe. We do not currently sell through any application marketplace, and we do not store your full card details.
By purchasing, you authorise Tripsy and Stripe to charge the applicable fees, taxes and other disclosed charges to your chosen payment method.
Memberships renew automatically at the end of each billing period unless cancelled before the renewal date. The renewal price is the then-current price for your plan, unless a different price was expressly communicated at purchase, you hold a protected price such as a Founding Membership, or law requires otherwise.
Where required by law, we will send advance notice before an annual Membership renews and before any change to your renewal price takes effect. You are responsible for keeping your payment method valid.
11.1 Failed payments
If a renewal payment cannot be collected, our payment provider will retry over a retry period. Your access continues during that retry period — we do not remove access on a single failed payment.
If the subscription ultimately becomes unpaid or is cancelled, your Account moves to the free plan. Downgrading does not delete your Content: itineraries already unlocked by a Trip Pass stay unlocked, and everything else is retained subject to the free-plan access limits in section 1.5.
12. 12. Trip Pass
A Trip Pass is a one-time purchase that permanently unlocks a single itinerary.
- It is a one-off payment and does not renew.
- It unlocks one specific itinerary, on the Account that bought it, and confers no other paid features.
- It is non-transferable and cannot be resold, gifted or reassigned.
- The unlock is permanent for that itinerary, unaffected by the seven-day free-plan limit, by cancelling a Membership, or by downgrading.
- It does not grant access to Circle, which requires an active Membership and Verification.
Because a Trip Pass delivers digital content immediately, you agree performance begins at once. Where you have a statutory right of withdrawal, you acknowledge that by completing the purchase and gaining immediate access you request immediate performance and, to the extent permitted by law, waive that right. Nothing here limits a right that cannot be waived. Refunds are otherwise handled under our Refund Policy.
13. 13. Cancellation
You may cancel at any time from your Account, using Manage billing on the Membership screen. This opens our payment provider's secure billing portal, where you can cancel, update your payment method and view invoices. You do not need to contact us.
Cancellation prevents future renewal charges. It does not automatically entitle you to a refund for the current period, except where required by law or provided in our Refund Policy.
Unless law requires otherwise, cancelling does not immediately end access. Access continues to the end of the period you have paid for, then the Account moves to the free plan. Cancelling does not delete your Account or Content — see section 17.
14. 14. Pricing and taxes
All prices are displayed in the currency presented at checkout, and the checkout page is authoritative as to the amount and currency charged. Applicable taxes may be added where required by law.
You are responsible for duties, taxes, bank charges, currency conversion fees and similar charges imposed by your financial institution or local authorities, including where your card is denominated in a different currency from the one charged.
We may correct genuine pricing errors, technical errors and obvious typographical mistakes.
15. 15. Promotional offers
We may offer introductory pricing, promotional discounts, referral incentives, complimentary trial periods, Founding Memberships or other limited-time offers.
Unless expressly stated: offers cannot be combined; promotional pricing applies only to the specific offer; offers have no cash value; and offers may be withdrawn or modified for future purchases at any time.
We may refuse or withdraw promotional benefits where fraud, abuse or manipulation is reasonably suspected, including attempts to obtain a limited offer more than once.
16. 16. Suspension and termination
We may suspend or terminate your Account immediately if we reasonably determine that you have violated these Terms or the Community Guidelines; engaged in fraudulent or unlawful conduct; abused the Services or other Members; attempted to circumvent Verification or eligibility requirements; compromised the security or integrity of the Platform; or exposed Tripsy or its Members to unreasonable legal or security risk.
Where reasonably practicable we will give notice first, but we may act immediately to protect the Platform, its Members, or to comply with law.
Termination does not relieve you of payment obligations incurred before it. Where we terminate without cause, we will refund any prepaid, unused portion of a Membership.
17. 17. Account deletion
Account deletion is currently handled by request. To delete your Account and associated data, email hello@getripsy.com from the address on your Account. We will action it within the timeframe in our Privacy Policy, except where law requires us to retain something.
Deleting your Account does not automatically cancel an active Membership. Cancel first under section 13, then request deletion. If you request deletion while a Membership is active, we will cancel it as part of processing your request.
We may retain information after closure where required by law, or as necessary to resolve disputes, prevent fraud, enforce these Terms, or comply with regulatory obligations.
18. 18. Acceptable use
You may use the Services only for lawful purposes, in accordance with these Terms, the Community Guidelines and applicable law.
You agree to use the Services in a way that respects the safety, privacy and dignity of other Members, and that reflects the purpose of Circle as a trusted space for women travellers.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your own personal, non-commercial travel planning and community participation. All other rights are reserved.
19. 19. Prohibited conduct
Safety and conduct
You must not harass, bully, threaten, stalk, intimidate or abuse any person; post hateful, discriminatory, sexually explicit, violent or degrading content; publish another person's private information (including full name, address, workplace, travel plans or contact details) without consent; solicit romantic or sexual contact, or use the Services as a dating or matchmaking service; misrepresent your identity, sex, age or eligibility for women-only features; or circumvent Verification or eligibility requirements.
Content
You must not post content you have no right to post; post spam, advertising, affiliate links, recruitment or commercial solicitation without our written permission; post knowingly false, misleading or defamatory statements about any person or business; or post content promoting illegal activity or endangering others.
Platform
You must not access the Services by automated means, including scraping, crawling or bulk extraction; reverse engineer, decompile or attempt to derive source code or model weights; probe, scan or test the vulnerability of the Platform, or breach its security or authentication; introduce malware; interfere with or place undue load on the Services; resell, sublicense or commercially exploit the Services or their output without written permission; or use the Services or their output to train, fine-tune or develop any competing artificial intelligence model.
20. 20. Community standards
Circle exists so that women can share honest, useful travel information. Taking part is a privilege conditional on your conduct.
When posting you agree to share information honestly and in good faith; base safety observations on your own genuine experience; respect that other Members' experiences may differ; and refrain from naming or targeting individuals.
Where you describe a business, accommodation, driver, guide or other third party, your statement must be your own honest firsthand experience, or clearly identified as something you were told. Do not present speculation or rumour as fact.
Tripsy does not verify Member statements about third parties and does not adopt them as its own. Our Community Guidelines form part of these Terms and set out expected conduct in detail.
21. 21. Your content
User Content means anything you submit, upload, post or transmit through the Services, including Circle posts, photographs, video, travel notes, and itineraries you author or edit.
You are solely responsible for your User Content, including its accuracy, legality and consequences. You represent that you own or have all necessary rights to it and that it infringes no third party's rights and violates no law.
Tripsy does not pre-screen or verify User Content. Content published by Members is theirs. We do not endorse, adopt, verify or guarantee the accuracy of any Member statement, review, recommendation or safety observation, and we are not the author or publisher of such statements. Any reliance you place on User Content is at your own risk.
22. 22. Licence granted to Tripsy
You retain ownership of your User Content. We do not claim ownership of your itineraries, photographs, notes or posts.
By submitting User Content you grant Tripsy a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, cache, reproduce, adapt and modify (for formatting, resizing, transcoding and technical delivery), publish, display and distribute it solely to operate, secure, improve and promote the Services.
This licence exists so we can run the product — a post cannot appear in Circle unless we may store and display it. Where we wish to use your User Content in external marketing that identifies you, we will ask you first.
The licence ends when you delete the content or your Account, except that we may retain server backups for a reasonable period, retain copies where required by law or necessary to resolve a dispute or a moderation matter, and except for content others have already shared or copied.
If you send us suggestions or feedback, we may use them without restriction or obligation to you.
23. 23. AI-generated content
Parts of the Services generate content using artificial intelligence in response to your inputs, including itineraries, recommendations, budgets, packing lists, and travel, visa, health and safety information.
Ownership: subject to your compliance with these Terms, you retain ownership of the prompts, voice recordings, travel details and other original content you submit. To the extent Tripsy holds any rights in AI Output generated for you, Tripsy assigns those rights to you.
AI Output is not unique. Because it is generated statistically from similar inputs, other users may receive identical or substantially similar output. You acknowledge that AI Output may not be original or exclusive to you, that you cannot claim exclusivity over it, and that we may generate similar output for others.
You may not use AI Output in a way that violates these Terms, misrepresents it as professional advice, or trains or develops a competing AI model.
24. 24. Your responsibility for AI outputs
AI Output may contain inaccuracies, omissions, fabricated details, outdated information or recommendations unsuitable for your circumstances. This is inherent to the technology, not a defect in the Services.
AI Output is for planning and information only. You are solely responsible for independently verifying any travel, visa, entry, transportation, accommodation, health, vaccination, safety, financial or legal information before relying on it, and in particular before booking travel, entering a country, or making a health or safety decision.
Verify against official and authoritative sources: government travel advisories and immigration authorities for entry and visa matters; qualified medical professionals for health matters; and the provider directly for prices and availability.
We do not warrant the accuracy, completeness, currency or fitness for purpose of AI Output, and provide it without professional advice of any kind.
25. 25. Intellectual property
The Services — including the Platform, software, models, prompts, designs, text, graphics, logos and the Tripsy name and marks — are owned by Tripsy or its licensors and protected by intellectual property law. Nothing here transfers those rights to you.
You must not copy, modify, distribute, sell or create derivative works from any part of the Services except as expressly permitted.
If you believe content on the Services infringes your copyright, email hello@getripsy.com with identification of the work; the location of the content; your contact details; a statement that you believe in good faith the use is unauthorised; a statement that your information is accurate; and your signature (electronic is sufficient). We will review valid notices and may remove the content. We may forward your notice to the Member who posted it, and we accept counter-notices at the same address.
26. 26. Reporting violations
If you encounter content or conduct that violates these Terms or the Community Guidelines — including harassment, threats, impersonation, doxxing, scams, or content that puts a Member at risk — report it using the Report action on the post, or email hello@getripsy.com.
If you believe you or someone else is in immediate danger, contact local emergency services before contacting Tripsy. Tripsy is not an emergency service and cannot intervene in events occurring outside the Platform.
Reports are confidential: we do not tell the reported Member who reported them.
27. 27. Content moderation
We may remove, restrict or disable access to any content, at any time, at our discretion, where we reasonably determine it violates these Terms or the Community Guidelines, creates a legal or safety risk, or is otherwise harmful. We may act with or without prior notice.
We may also limit a Member's ability to post, restrict access to community features, or suspend or terminate an Account under section 16.
We are not obliged to monitor. We have no general obligation to monitor, screen or review User Content and do not do so in the ordinary course. Removing some content creates no duty to remove other content, and does not make us the author or publisher of content we leave up.
Where we remove content or restrict an Account we will, where reasonably practicable, tell the affected Member and give them a means to respond. We may decline where notice would risk harm, prejudice an investigation, or breach a legal obligation. Where reasonably practicable, an appeal is reviewed by someone other than the person who made the original decision.
Content removed for violating these Terms may be retained for evidentiary, legal or safety purposes.
28. 28. Repeat infringers
We will suspend or terminate the Accounts of Members who repeatedly infringe intellectual property rights, and of Members who repeatedly violate these Terms or the Community Guidelines.
We consider the seriousness of the conduct, whether it was deliberate, and the risk to other Members. Serious violations — including threats, doxxing, sexual harassment and circumventing Verification — may result in immediate permanent termination on a first occurrence.
A Member terminated for such conduct may not create a new Account without our written permission.
29. 29. Platform integrity
You must not undermine the integrity or trustworthiness of the Services, including by creating fake Accounts, manipulating community features, using another Member's Verification, or attempting to identify Members outside the Platform against their wishes.
We may take reasonable technical and operational measures to detect and prevent abuse, including rate limiting, automated detection of suspicious activity, and requiring re-verification.
Nothing in these Terms obliges Tripsy to guarantee the conduct of any Member, and our ability to moderate does not make us responsible for Member behaviour, on or off the Platform.
30. 30. Third-party services
The Services may integrate with or provide access to products, services, websites, applications, APIs, payment processors, mapping services, identity verification providers, travel information providers, artificial intelligence providers or other third-party services.
We do not own or control them. Your use of any third-party service is governed by that provider's own terms and privacy practices. We are not responsible for their availability; changes they make; interruptions or outages; pricing they display; their data accuracy; their security practices; or losses arising from your use of them.
Including a third-party service is not an endorsement, recommendation, partnership or guarantee unless expressly stated.
30.1 Affiliate relationships
Tripsy may, from time to time, earn commissions through certain third-party booking links, at no additional cost to you. Where applicable, any commercial relationship will be disclosed in accordance with applicable law.
Commercial relationships do not influence the generation, ranking or ordering of AI-generated itineraries or recommendations. We do not accept payment for placement. Should we introduce sponsored placements, they will be clearly identified as sponsored and will not be presented as part of a generated itinerary.
Our current affiliate relationships are described in our Affiliate Disclosure.
31. 31. Artificial intelligence services
Certain Services use artificial intelligence to generate travel recommendations, itineraries, destination information, budgets, safety guidance, inspiration and other informational content.
Artificial intelligence is probabilistic technology. AI Output may be incomplete; contain inaccuracies; become outdated; omit relevant information; misunderstand your request; produce inconsistent recommendations; or be unsuitable for your circumstances.
It is provided solely for general informational and planning purposes. You remain solely responsible for independently verifying any information before relying on it.
32. 32. No professional advice
Tripsy does not provide legal advice; immigration advice; tax advice; financial advice; investment advice; medical advice; healthcare advice; emergency response services; personal security services; or professional travel consultancy.
Nothing in the Services should be interpreted as professional advice.
Where the Services display information on visas, vaccinations, health precautions, customs requirements, taxation, travel documentation or legal requirements, it is general informational guidance and should be verified with the relevant government authorities or qualified professionals before you make travel decisions.
33. 33. Travel information disclaimer

34. 34. Safety information disclaimer
We may provide general information on destination safety; neighbourhood characteristics; local customs; common scams; transportation options; emergency contacts; cultural practices; health considerations; and other travel safety topics. This is general guidance only.
Safety conditions change rapidly and differ by personal circumstances, time of day, location and other factors beyond our knowledge or control.
We do not guarantee that any destination, neighbourhood, accommodation, activity, transportation provider or travel experience is safe. You remain solely responsible for exercising independent judgment and taking appropriate precautions.
35. 35. Member interactions
Tripsy provides technology allowing Members to discover and interact with one another through community features. We do not supervise, monitor, arrange, organise or control relationships formed between Members.
We are not responsible for conversations between Members; meetings between Members; friendships; business relationships; financial transactions between Members; accommodation arrangements; transportation arrangements; shared travel; or any other interaction between Members.
Members independently decide whether to communicate, share information or meet. Exercise appropriate caution when interacting with individuals you encounter through the Services, online or offline.
36. 36. Verification disclaimer
Verification confirms only that a Member successfully completed the identity verification process provided by our independent verification provider, on the date that check was performed.
Verification does not constitute a criminal background check; a character assessment; an employment screening; an endorsement; a guarantee of future conduct; a guarantee of identity at any later time; confirmation that the verified individual is the person currently using the Account; or a certification of safety.
We make no representation that interactions with Verified Members will be safe, appropriate, lawful or free from risk.
37. 37. Assumption of risk
Travel inherently involves risk. By using the Services you acknowledge that travel may involve circumstances beyond our control, including accidents; illness; crime; fraud; theft; transportation delays; flight cancellations; accommodation issues; political instability; natural disasters; severe weather; public health emergencies; civil unrest; changes in government regulations; and other unforeseen events.
You voluntarily assume the risks associated with your travel decisions, your reliance on information obtained through the Services, and your interactions with other Members. Nothing here limits any liability that cannot lawfully be excluded — see section 39.
38. 38. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available”.
We disclaim all warranties, express, implied, statutory or otherwise, including implied warranties of merchantability; fitness for a particular purpose; non-infringement; uninterrupted availability; accuracy; reliability; and satisfactory quality.
We do not warrant that the Services will always be available; will be error-free; that AI Output will be accurate; that content will always be current; that defects will be corrected immediately; or that the Services will meet every User's expectations.
Where you deal as a consumer you may have statutory rights that cannot be excluded. Nothing here affects those rights.
39. 39. Limitation of liability
39.1 Excluded losses
To the fullest extent permitted by law, Tripsy, its directors, officers, employees, contractors, affiliates, licensors and service providers shall not be liable for indirect, incidental, consequential, special, exemplary or punitive damages arising out of or relating to the Services, including loss of profits; loss of revenue; loss of business opportunities; travel disruptions; missed flights; visa refusals; accommodation issues; transportation issues; data loss; reputational harm; personal disappointment; AI-generated inaccuracies; user-generated content; or interactions between Members.
39.2 Cap
To the maximum extent permitted by law, our total aggregate liability arising from any claim relating to the Services shall not exceed the greater of (a) the total amount you paid Tripsy in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD $100.
39.3 Liabilities that are never excluded
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence, where such liability cannot lawfully be excluded;
- fraud or fraudulent misrepresentation;
- gross negligence or wilful misconduct, where such liability cannot lawfully be excluded;
- any other liability that cannot lawfully be excluded or limited under applicable law, including mandatory consumer protection rights in your country of residence.
Sections 39.1 and 39.2 are subject to section 39.3 in all cases.
40. 40. Indemnification
If a third party brings a claim against Tripsy because of something you did, you agree to be responsible for that claim.
Specifically, you agree to indemnify Tripsy, Quantum Ventures FZC and its officers, directors and employees against claims, losses, damages, liabilities and reasonable legal costs arising from your breach of these Terms or the Community Guidelines; your unlawful conduct or violation of law; Content you posted; or your infringement of a third party's rights.
This applies only to the extent the claim results from your own deliberate or negligent act or omission, and not to the extent it arises from our own act, omission or breach.
We will notify you promptly of any claim, will not settle it without your consent (not to be unreasonably withheld), and will give you a reasonable opportunity to participate in its defence.
Where you are acting as a consumer, this section applies only to the extent permitted by the consumer protection law of your country of residence, and does not limit any statutory right you have. This obligation survives termination.
41. 41. Modification or discontinuation of the Services
We are actively developing Tripsy. We may add, change, improve, restrict, remove or discontinue features, or the Services as a whole, at any time.
Where a change materially reduces a feature you are currently paying for, we will give reasonable advance notice, and:
- if you hold a Membership, you may cancel under section 13 and we will refund the unused portion of your current billing period;
- an itinerary you unlocked with a Trip Pass remains accessible for as long as we operate the Services in a form that can display it.
If we discontinue the Services entirely, we will give as much notice as reasonably practicable, provide a means to export your itineraries where technically feasible, and refund the unused portion of any prepaid Membership. Nothing in this section limits mandatory consumer rights.
42. 42. Governing law
These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the Emirate of Sharjah and the federal laws of the United Arab Emirates applicable therein, without regard to conflict of law principles.
Where mandatory consumer protection laws in your country of residence apply and cannot lawfully be excluded, nothing here limits or removes those rights.
43. 43. Dispute resolution
Please contact us first — most things are resolved that way. Before commencing proceedings, you agree to give us written notice describing the dispute and a reasonable opportunity to resolve it in good faith.
Nothing here prevents either party seeking urgent injunctive or equitable relief to protect legal rights.
Where permitted by law, disputes not resolved informally shall be submitted to the competent courts of the Emirate of Sharjah, United Arab Emirates. If mandatory law in your jurisdiction provides a different forum or grants additional consumer rights, those remain unaffected.
44. 44. Force majeure
We are not liable for delay or failure to perform where it results from events beyond our reasonable control, including acts of God; natural disasters; pandemics or epidemics; war; terrorism; civil unrest; governmental actions; sanctions; labour disputes; internet outages; cloud infrastructure failures; telecommunications failures; cyberattacks; or failures of third-party service providers.
We will use commercially reasonable efforts to resume normal operation as soon as reasonably practicable.
45. 45. Electronic communications
By creating an Account or using the Services, you consent to receive communications from us electronically, including account notifications; billing notices; security alerts; legal notices; service announcements; product updates; and support communications.
Electronic communications satisfy any legal requirement that communications be in writing, except where law requires otherwise.
46. 46. Notices
Legal notices to Tripsy should be sent to the contact details in section 52, or such other address as we designate.
We may give notice to you by email; notification within the Services; publication on our website; or any other reasonable method permitted by law. You are responsible for maintaining a valid email address on your Account.
47. 47. Assignment
You may not assign or transfer any rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms in connection with a merger, acquisition, corporate restructuring, financing transaction, sale of assets, or operation of the Services, provided the assignment does not materially reduce any mandatory consumer rights available to you.
48. 48. Entire agreement
These Terms, together with the Privacy Policy, Community Guidelines, Refund Policy, Cookie Policy and Affiliate Disclosure, constitute the entire agreement between you and Tripsy regarding the Services and supersede all prior understandings on the same subject matter.
49. 49. Severability
If any provision is held invalid, unlawful or unenforceable, it shall be enforced to the maximum extent permitted and the remaining provisions remain in full force.
50. 50. Waiver
Our failure to enforce any provision is not a waiver of it or of any other right. Any waiver must be in writing and signed by an authorised representative of Tripsy.
51. 51. Survival
These survive termination where their nature requires it: intellectual property rights; the licence in section 22; the disclaimers in sections 30 to 38; limitation of liability; indemnification; governing law; dispute resolution; payment obligations incurred before termination; and any other provision intended by its nature to survive.
